and make sure you are married for 9 months ...they hide that little jewel of requirement unless you start digging for it ..age 60 and married 9 months ....I unfortunately was only married legally a little over 7 months when my husband had an unexpected heart attack ...even though we lived together years as man and wife before getting that piece of legal paper ..they will fight you on the common law loopholes too and shoot you down ..and make you feel shamed for even thinking you are due some of the survivors benefits as a widow.(er) .....something needs to be changed ....it is being set aside from SS taken out of our paychecks ..and my husbands
's hard earned dollars for this very reason ..an insurance type of thing ....government will find every loophole not to pay out ..it's just not right..morally...Time to start those squeaky wheels a-screechin' to our congressmen.....things need to be looked at on an individual basis ...not I simple rule for all .....every case is different..and I for one am frustrated to the gills dealing with attitude at the local SS office....I am NOt a golddigger...nor is this a moral issue ..I am a grieving widow trying to keep myself afloat ..and yes I am still working and paying in taxes that are supposed to help me in my need....I won't hold my breath on that one....

I am an American citizen. I married my wife in the Philippines. She is a philipino resident and has never been in the USA. I live in the USA. She won't come to the USA. I am 72 years old. I draw social security. If I die can she draw social security from me. My first wife died whom I was married to for 35 years. I have been married to the wife from the Philippines for 6years.

My cousin, who is a naturalized citizen, has never worked in the U.S. but her husband did. When he dies, will she receive SS benefits? Sorry for the question, but I'm so confused at all of the answers I've seen on the Internet!

I was married (1976) for 17 years, we divorced (1993). My Ex remarried. I remarried (1998), 4 years later divorced. I started drawing Social Security at age 62 on my earned wages, which was very low but I needed to. When I turned 65 (2015), I contacted the Social Security office by phone, to see if I was able to draw based on my First husband earnings (his age was 63). Social Security increased my income which was double from what I had been receiving. My First Ex husband passed away 4 months ago. Could I refile and receive more income? It is so confusing to me.

Hello my Husband dies in October of this yr. we have a 10 yr old daughter. we are going to get survivors benefits i get them early until shes 16 I have 1 question me and my daughter get ssi also i was told by social security they would cut the ssi way back on us both. Is this info accurate or can me and my daughter get maxium benefits on ssi or will ssi be cut back?

I know this woman who walked out on her sick husband to cheat with another woman's man. They have been together for 6 months and now her husband has died about a month ago. The husband received disability, can she collect anything ? She's only 42 and works full time. They have children but all are older than 18 and nine are disabled. Can she collect anything, if so how much will she get? And how long before she can collect it? I honestly don't think that since she left the husband for another man, she should get a dime! She's promised the man half of the money if he stays with her!!!

My friend lost her husband October 2015, can she claim her husband pension from private companies. She is 81 years old now. She was allowed to get widows allowance for one year only, this finishes in October 2016.

I was married for 7 years and 11 months and my husband passed away on February of 2011. We were living in New Jersey when he passed away and it was also in New Jersey where I got my citizenship by naturalization in 2007. For work reasons I moved back to Brazil in March of 2011 and now I'm living in Canada. I am 57 years now and I only worked for a few months while in USA. I'm counting on a survival's benefit on my late husband social security record when I turn 60. I didn't marry again but I would like to know: "if I live in a common law partnership in Canada will I be disqualified for the survival benefit in U.S.?"

Don't think this is legal advice because it is not, as I am not a lawyer. It's my understanding you have to be married for at least 10 years before you can collect on your spouses SSI. She may be eligible for other benefits but you will have to check with the SS office to know for sure.

My husband died at the age of 27 after 6 1/2 years of marriage I did collect survivers benefits for myself and my children. Am I entitled to any retirement benefits under his social security?

Unique question. My mom got married in 1980 the husband passed away in 2003 my mom apply for his SS benefits,come to find out he never got divorced from his first wife in another state. Social Security Administration said the first wife is collecting his SS and my mom cannot get benefits. have anybody ever heard something like this before?

I have a question regarding the definition of remarriage. I do not wish to remarry as I will lose not only SS benefits but a lot more from my husbands 30 years of Federal service. However I have a very special man in my life that wishes to be married. I was thinking of a compromise. Would it be acceptable to appease his desire to be married by having a marriage performed in another country that is not considered valid in the US unless it was later filed in a US court? I'm assuming if it is never filed here, then it wouldn't be a US recognized marriage. This would allow him to satisfy his desire for marriage, and still preserve my benefits. Is this wrong? Is it legal to have a non-filed marriage for the sake of preserving benefits?

I am 52 yrs. old and my husband pasted away Feb. 9th of 2014' he was 51 at the time. We were together for 13 years but had just gotten married a little less then a year prior to his passing. He was receiving disability for approx. 3 yrs. prior to his passing. He was given 3 yrs for congestive heart failure, but went 5 yrs. He was the sole income provider. My question is: Am I able to receive his disability now or when I turn 60 with only being married for 9 moths.

Hi,
My grandfather is terminal, and his wife seeks to collect his SS after his passing. Does anyone know anything about Florida law as it pertains to spousal duties? My grandfather had a stroke because she stopped giving him Plavix (he has stents in his heart, and has had a stroke, so he needed the medication). Today the doctor's confirmed that he had a stroke last night. She did not call 911. She only left me a message that I might want to pass by. When I got there he was in bed with a diaper on, and completely non-responsive. Is there anything I can do so that she is not able to claim his SS after all this?
Any information would help.

My husband was diagnosed with colon cancer he went into remission and now they've diagnosed him with stage 2 leukemia the doctors have gave him a 35% chance to make it we've only been married for 3 years but been together for almost five am I entitled to benefits if something happens
