He just got notice he was approved back pay included. My understanding is he has to meet with a ssi rep. can he do so being in jail? If not what will happen to his backpay? Is he still entitled to it upon release or do we have to do this whole process over again? They simply do not care.  The employees don't do their jobs in stopping checks that should be stopped.  They don't care who is getting them, they just send them and consider their job done.  My niece has been getting my brothers ss check for the past 16 months while he is incarcerated. He has been in jail for the past 16 months.  His daughter obtained his power of attorney when he was arrested and started having his ss check sent to her.   I have sent documents to ss showing his arrest that was published in the local newspaper,  I filled out a fraud form and mailed to ss,  and I also called their fraud hotline to report that he is in jail.  The person I spoke to in March 2015,  said the check should have been stopped after my brother was incarcerated 30 days.  He said he would submit the information to the correct  department.  However, social security has not stopped his checks.  His 27 year old daughter, who has been unemployed well over a year, continues to receive the check which is used for her personal needs.  She seldom answers the phone when he calls her from jail.  She has visited him only 4 times in the past year, although she lives only minutes away.  She doesn't even put money in his commissary account for him even when he begs her to.  So, although he is getting no benefit from his ss check being sent to her, he will be the one who has to pay it back.  Social Security obviously doesn't care or they would have stopped this.  No wonder we hear that ss is going broke and there will be none when we get to retirement age.  They don't care. Minor children received children's SSI benefits. So, if a parent receives a Social Security check it is as a payee for the disabled child and not auxiliary benefits to the parent. As a a payee, the parent has responsibilities to use the benefits for the benefit of the disabled child. See &lt;a href="http://www.ssa.gov/pubs/EN-05-10076.pdf" rel="nofollow noopener" target="_blank" title="http://www.ssa.gov/pubs/EN-05-10076.pdf"&gt;http://www.ssa.gov/pubs/EN-...&lt;/a&gt;. I have 4 steel ray cages in my low back , a plate in my R, ankle and I have emphysema. My attorney at Friday and Cox has been unable to restore my benefits. I am enrolled at Prestigous (Kaplan University Legal Studies) I am studying Environmental Policy and Management. I am doing my projects in each class (on-law) on Social Security Reform with a mind to the injured who have done time. I correlated both classes this term on this subject. I still have no benefits and even cash assistance has been denied by the heads of the Mafia.
