If you have an attorney, they should be able to get the hearing recording. Is part of the online file that attorneys can access. Otherwise, it can often be obtained from the hearing office, the Appeals Council (if the case is pending there), or through the local office.

Re: Social Security hearing denial? SSA will commonly lose files and documents that need to be replaced.

Re: Social Security hearing denial? Of course this is coming after the Appeals Council refused to review. Of course the ALJ depended HEAVILY on this recording so I couldn't ever mount a proper defense of all the things the Judge misrepresented and outright lied about. He starts off the hearing with a nasty tone stating that it will be very difficult to prove my case (the print outs of all my medical was well over a foot high at this time). So, yes they will go out of their way to deny you getting a recording if it doesn't bode well for them.

Re: Social Security hearing denial? Several months ago I sent a request for a copy of my file and was told last week after calling to check on the status of my request that they do not know when it will be sent out.
In January they told me that they never received my request for review and it was sent certified mail with a return receipt, so I know that they received it. Yet, They continue to use the wrong date that my request for review was sent and I even mailed them a copy of the return of receipt card from the P.O. Which they received on March 2,2015.

Re: Social Security hearing denial? See what s/he thinks. There is often disagreement about the evidence. However, that is what appeals are for. An unfair hearing complaint is a different matter.

Re: Social Security hearing denial? I think after listening to the audio my Attorney should have help us file an unfair hearing against the ALJ, what is your opinion?

Re: Social Security hearing denial? Hopefully the Appeals Council will approve the case or give your wife another hearing.

I wish you the very best.

Re: Social Security hearing denial?
