Colorado Social Security Disability Benefits Law: Social Security Consultative Examinations

    I filed for disability benefits and I have earned enough credits. I also MEET 2 Adult Listings of Impairments. I have a Board Certified doctor and another doctor with an MD and a Phd and the doctor is a high ranking doctor at University Of Colorado Hospital. Both of the Medical Source Opinions agree that my condition is "SEVERE" Life-Long and a Permanent and Total Disability.

    With that said I was scheduled for a Consultative Exam. The contraced Social Security doctor spent 1.5 hours with me discussing my disability. He read my treating doctors opinions and at the end of the Exam he agreed with them on my illness that I was Permanently and Totally disabled.

    However, Disability Determination Services still has not ruled on my case. What could be the delay and Why was I sent for a Consultative Exam when it is clear in the Medical Source Opinions of 2 treating doctors that I MEET 2 Adult Listing Impairments? They are clearly noted on the Medical Source Opinions?

    Roger, it sounds like you have a done a great job documenting your case. That's terrific and you should be congratulated.

    I have repeatedly seen Social Security do what you describe. They just seem to want to hear what their own doctors say. Unfortunately, DDS also usually goes with their own doctor's opinions over the claimant's doctors' opinions (in my experience).

    I'll keep my fingers crossed for you. If they deny you, at least you will have great evidence for the appeal. That may be small consolation, but I find that the judges are much more willing to consider the treating physicians' opinions.
