I am a young widow (29) when spouse died in 2014. I have two young children ages 9 and 10. I did not apply for benefits because I was told the sum of benefits would stay the same but divided between the three of us. Considering the amount of time that has passed since my husbands death, would I still be eligible for benefits? If misinformed would I be eligible for back payment? My mom was switched from her SS to survivors benefits.  She didnt receive anything in November but did receive a check in December. Today she received a letter saying they had overpaid my dad $19,000 and starting in April they were taking her entire check until it is paid. This is her only income and she will be 70 nect month. It is my understanding that they should be entitled to widow's benefits. Does SS not automatically transfer their wives benefits over to their spouses or do they have to go into the office and request it? Are they not entitled to receive their benefits? It leaves them less to live on since the money they were both receiving was what they used to pay their mortgage and bills.
